Please read these Official Rules carefully. By participating in the Survey and Sweepstakes, you agree to these Official Rules.
- Qualifications: NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.. Void where prohibited. This Sweepstakes is open to legal residents of the 50 United States and the District of Columbia who are 18 years of age or older. MyFitnessPal, Inc. (“sponsor) are ineligible to enter. Eligible participants in the Sweepstakes will be referred to as “Entrant” or “You.” By participating, you agree to these Official Rules and the decisions of Sponsor, which are final and binding in all respects.
- Promotion Period: This contest (“Sweepstakes) will begin on July 8, 2024 at 12:01 a.m. ET (E.T.) and ends on July 15, 2024 at 11:59 PM ET (“Application periodEntries must be received and recorded by Sponsor during the Entry Period. Sponsor’s clock will be the official timing device for the Sweepstakes.
- Application method: Participants will automatically receive one entry when they complete and submit the survey, or if they wish to enter without completing the survey, e-mail community@myfitnesspal.com To enter the sweepstakes, please provide us with your contact name and email address. Limited to one entry per person. Please fill out the survey to enter. Entries will be accepted as above or by email, but are not a two-way street. Sponsor reserves the right to review all entries. Sponsor reserves the right, in its sole discretion, to disqualify from the Sweepstakes any Entrant it believes to be in violation of these Official Rules. To be eligible for the Sweepstakes, all Entries must be received by the Entry Period and contribute to one eligible pool of entries (collectively, the “EligibilityThe Sweepstakes winner will be selected from entrants who meet the requirements set forth herein.
- drawingWithin thirty (30) days following the end of the Entry Period, Sponsor or its designee will randomly select ten (10) winners (“winner“) will be drawn at random from the eligible entries received by Sponsor or its agents. In the event that a winner is disqualified pursuant to these Official Rules or a winner fails to take all necessary steps to claim the prize, an alternate winner (“Alternate WinnerWinners may be selected at Sponsor’s sole discretion. The winner and, to the extent necessary, any alternate winners will be notified via email. Sponsor or its designee will use reasonable efforts to send the prize to the winner and/or any alternate winners within ninety (90) days following the drawing date once the winner has provided an address by responding to the congratulatory email requesting a mailing address, but Sponsor is not responsible for failure to send the prize within such time period. If a winner fails to respond with the requested information, cannot be contacted within forty-eight (48) hours, or violates these Official Rules, that winner may be disqualified, the prize may be forfeited, and the prize may be awarded to an alternate winner at Sponsor’s sole discretion.
- Prizes, Odds of Winning, Approximate Retail Value (ARV): The prize to the winner selected from eligible entries will be a $25.00 Amazon Digital Gift Card. The gift card is subject to the terms and conditions provided therewith. All unstated costs, expenses and taxes, if any, are the sole responsibility of the winner. No substitutions of prizes are permitted, except for substitution of a prize of comparable value at Sponsor’s sole discretion. Prizes are not transferable. Sponsor makes no representations, warranties or guarantees of any kind regarding the quality, suitability or operation of the prize. Approximate retail value (“ARVA’sThe “ARV” (retail value) of each prize is $25, with a total value of all prizes of $250. Odds of winning a prize depend on the total number of eligible entries received.
Sponsor uses Amazon.com trademarks for reference purposes only. No sponsorship, endorsement, or permission of any kind is intended or implied by such use.
- Disqualification: Sponsor or its agents expressly and without limitation reserve the right, in its sole discretion, to disqualify any Winner and/or Alternate Winner for any of the following: (a) failure to provide accurate personal or contact information during the Sweepstakes Period, or (b) if any notification is deemed undeliverable for any reason. In addition, Sponsor or its agents expressly reserve the right to disqualify any Participant or prospective Participant for any conduct that Sponsor or its agents, in its sole discretion, deems detrimental or disruptive to the proper operation of the Sweepstakes, including, but not limited to, tampering with the Sweepstakes entry process or the operation of any website (including mobile website), conduct that violates these Official Rules or any terms of Sponsor’s website, submission of videos or other materials that contain inappropriate language, content that promotes discrimination of any kind, or other objectionable material. Do not behave in an unsportsmanlike or disruptive manner, or with the intent to threaten, abuse or harass any other person. In the event of disqualification, the winner or alternate winner will automatically forfeit any prize in this Sweepstakes and Sponsor will have no further obligation to the disqualified winner or alternate winner.
- LIMITATION OF LIABILITY: The Released Parties (defined below) are not responsible for, and specifically disclaim any liability resulting from, any of the following, regardless of cause: (1) inaccurate information caused by entrant, wireless carrier, Internet service provider or unauthorized human intervention; (2) technical problems or failures of any kind, including, but not limited to, malfunctions, interruptions or disconnections in transmissions or connections, phone lines, network hardware or software, computer, equipment, programming errors, cable, satellite, cell phone towers, ISPs or wireless carriers; (3) bugs, viruses, worms, Trojan horses or similar malicious attacks; (4) printing, network, mechanical, electronic, technical, human or other errors or failures; (5) lost, incomplete, late, misdirected, garbled, undelivered, incomplete, stolen or damaged transactions, subscriptions or entries, or garbled, lost, misdirected or scrambled transmissions; or (6) unauthorized human and/or mechanical intervention in the Promotion or any other part of the participation process in this Promotion. The Released Parties are not responsible for any prize, including but not limited to the acts or omissions of third parties, the acceptance/possession, redemption, use/misuse and/or defects of any prize awarded hereunder. Everything provided to participants who register for this Sweepstakes is provided “as is” and without warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. Some jurisdictions do not allow the limitation or exclusion of liability for incidental, consequential or other damages, so some limitations or exclusions may not apply to participants.
- Disclaimer: By entering, entrants agree to accept and abide by these Official Rules. All decisions of Sponsor with respect to this Promotion are final. Entrant agrees that Sponsor and all of its officers, directors, employees, representatives and agents (“Released Parties”) shall not be liable for, and will hold harmless from, any injury, loss or damage of any kind, including without limitation direct, indirect, consequential or punitive damages to person or property, including death, caused in whole or in part, directly or indirectly by the receipt, possession, redemption, misuse or use of the prize, or participation in this Sweepstakes or any Sweepstakes-related activity. Sponsor shall have the right to refuse any withdrawal or waiver of any right, obligation or other obligations arising from or in connection with the Sweepstakes, including, but not limited to, any event, including fire, flood, epidemic, pandemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (whether or not war is declared), terrorist threat or activity, or any federal, state or local law, order or regulation, order of any court or other jurisdiction, or any other cause beyond Sponsor’s reasonable control (each an “Force majeureIn the event of a Force Majeure Event, Sponsor reserves the right, in its sole discretion, to shorten, modify, suspend, cancel or terminate the Sweepstakes without further obligation. If Sponsor elects, in its sole discretion, to shorten the Sweepstakes as a result of a Force Majeure Event, Sponsor reserves the right, but shall have no obligation, to award prizes from among all valid, eligible entries received up to the time of such Force Majeure Event.
- Disputes and Arbitration, Jurisdiction and Venue: Except where prohibited, you agree to submit to individual and exclusive arbitration of any Dispute in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in New York County, New York, and you waive any right to claim that such location is an inconvenient forum.
YOU FURTHER ACKNOWLEDGE AND UNDERSTAND THAT YOU ARE WAIVING ANY RIGHT TO A JURY TRIAL. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED OR REPRESENTATIVE ACTION. YOU HEREBY WAIVE ANY RIGHT TO ACT AS A REPRESENTATIVE, PRIVATE ATTORNEY GENERAL OR OTHER REPRESENTATIVE CAPACITY OR TO PARTICIPATE AS A MEMBER OF A CLASS IN ANY LITIGATION INVOLVING SUCH DISPUTES, AND ANY SUCH CLAIM MUST BE BROUGHT WITHIN ONE (1) YEAR AFTER THE CLAIM ACCRUES OR BE PERMANENTLY BARRED.
If this arbitration provision is found to be invalid, then all Disputes will be subject to the jurisdiction and laws of the state and federal courts located in New York County, New York, and you hereby submit to the personal jurisdiction and venue of such courts. All Disputes will be governed by and construed in accordance with the laws of the State of New York, without regard to or application of any conflict of law rules or principles.
In the event of any litigation or arbitration arising out of or relating to these Official Rules, the prevailing party shall be entitled to recover from the losing party all reasonable costs incurred, including staff time, court costs, attorneys’ fees and all other related expenses incurred in such litigation or arbitration.
